Retail Gear

The goods supplied are based on your authorised on-line or in person/in-store purchase; where you believe the goods do not match the sketch/description [for an on-line order], or if you believe there is a quality issue we have overlooked on any goods, we would like to know within 3 days of delivery, at which time we will take all reasonable steps to remedy the situation
Where there is a manufacturing fault, we will make repairs or replace the garment or provide a refund of the purchase price. FœnX™ will be solely entitled to make a decision as to which of those options will be taken but:
a) Repairs, replacements or refunds will be available only within a period of 3 months from the date of delivery on the goods;
b) You must supply proof of delivery of the goods, which must correspond with our records and those of our retailer
c) Repair, replacement or refund is limited to manufacturing faults only;
d) No repair, replacement or refund will be made for goods which have been worn or used in any other fashion; and
e) You will be responsible for the cost of return postage of any goods to us
We cannot replace goods based on the wrong size ordered by you or wrong design ordered by you
We cannot swap delivered goods for garments with different specifications if you change your mind after receiving the goods [eg: Hidden zip instead of Invisible] - what you specify at time of order is what we will supply
You should be aware that artwork/logos in your design which cross seams or zips may be subject to distortion or omission: finished goods cannot be refused by you on this basis
If you choose Invisible zips in any of your garments please be aware that Invisible zips are "fiddly" and require a light and patient hand when in use: it is a question of aesthetics at the expense of practicality - your design will invariably look better with a Invisible zip but Exposed or Hidden zips are more robust and easier to operate - please consider this when making your choice and handle Invisible zips with care
We will not repair/replace goods where a Invisible zip has been forced or damaged through what we believe to be heavy handed use

Custom Gear Step 1

You contact us and make an enquiry - at this stage we provide a written quote based on the specified quantities required - you sign authorised approval of the quote - you will note the quote is valid for 30 days from issue date; when you return the signed quote, we use the “garment quantity” information to help us schedule our factory production times so we can process your order in a timely fashion
By signing this quote form you agree to order the numbers specified at the quoted price, and to abide by our Terms and Conditions as found here below at step 4 - we cannot proceed without a signed confirmation of your order commitment

Custom Gear Step 2

Now we provide a sketch agreement to sign for your approval confirming our commitment to work together to produce your custom design and abide by our Terms and Conditions - there is no charge for design, but before we can start the sketch process we agree to embark on your custom designed jersey and you sign an agreement to that effect.
The agreement confirms that if you decide not to go ahead with your custom designed garment beyond this point you will pay a nominal amount of Au$500.00 to FœnX™ as a contribution towards time spent on the design thus far
NOTE - When you proceed with the design beyond this point this cost is nullified, and the sketch is a free component of the custom designed jersey

Custom Gear Step 3

The design process has commenced - you view the sketch on-line and for this you have a private page on our website ... you let us know if the design we have created is what you want, and make up to 3 amendments if necessary - this amendment process may take up to a week - until you are happy with the finished design - by then it's usually a couple of weeks down the track and we supply a final version of the sketch you to check and sign for your approval [either printed or emailed] so you can confirm this is the design you wish to proceed with
One important point to bring to your attention at this time is that if you supply us with your own design idea, or give us detailed and specific written/drawn instructions regarding your custom design but find you don't like your ideas once they are made into a sketch, there will be a Au$500.00 fee for the discarded design; this is because FœnX™ then need to commence a new sketch, and so effectively go through the design process twice for the same job
We can accept up to 3 changes on your custom design before charges will be incurred - costs are dependent on the time spent on making the extra changes - once the design is agreed upon, we issue an invoice to you - PLEASE NOTE; We require full and cleared payment before your order can be processed
Note - Payment details for EFT payment are shown on your invoice, or if preferred you can pay by credit card - PLEASE NOTE, THERE IS A 3% SURCHARGE FOR PAYMENTS MADE USING VISA OR MASTERCARD

Custom Gear Step 4

We supply you with an order form for you to sign, confirming cost, sizes and quantities - we can supply a range of template gear to try for size before ordering, so you are sure of getting the correct fit [please enquire for further details]
At this stage the order form will tell you about our Terms and Conditions and that before we can proceed with your order :
• We must have a signed authorised and valid FœnX™ quote showing confirmed quantities and agreed price
• We must have authorised sign-off on your FœnX™ sketch agreement
• We must have authorised sign-off on your approved FœnX™ custom designed sketch/s
• We must have a signed authorised order form showing a specific breakdown of sizes and quantities
• We require full and cleared payment before your order can be processed: Please note, there is a 3% surcharge applicable for payments made using VISA or Mastercard
• Additional charges may apply to sizes outside the standard size range, if they are available; orders cannot be refused by you on the basis of wrong sizes ordered by you
• All artwork and copyright for your custom design remain the property of SprintDesign®, who are authorised to use it freely as they see fit; any logos you supply will be removed first should FœnX™ choose to use the artwork in any way. Copyright does not apply where the design has been supplied by you and is not altered in any way by FœnX
• If you supply us with detailed and specific written/drawn instructions regarding your custom design but find you don't like your ideas when they are made into a sketch, there is a AUD$500.00 fee for this discarded sketch, as FœnX™then need to commence on a new sketch, and so effectively go through the design process twice for the same job
• You should be aware that artwork/logos in your design which cross seams or zips may be subject to distortion or omission: finished goods cannot be refused by you on this basis
• If you choose Invisible zips in any of your garments please be aware that Invisible zips are "fiddly" and require a light and patient hand when in use: it is a question of aesthetics at the expense of practicality - your design will invariably look better with a Invisible zip but Hidden or Exposed zips are more robust and easier to operate - please consider this when making your choice and handle Invisible zips with care
• While every effort is made to reproduce your colours, unless you have requested a colour swatch, printed colours may vary from sketch illustrations and web images. Also please note that Sublimation Inks display differently on different fabrics; finished goods cannot be refused by you on this basis.
• There can also be slight colour changes from order to order - all printers we use are colour calibrated however print colours can vary from one ink batch to another and from one printer to another, these are variables which are outside of our control; finished goods can also not be refused by you on this basis.
• Any logos or other artistic work supplied by you to be incorporated in your custom design/s are accepted by FœnX™ and applied on the basis that you have the right to do so, whether as owner of the copyright or design, or with the permission of the owner of the copyright or design. SprintDesign® accepts no liability for unauthorised use of materials supplied by you, and you will indemnify FœnX™ against any claims or demands made against FœnX™, or if a claim of breach of design or breach of copyright is made in these circumstances
FœnX™ will use up to a 5 cm display area for their logo to appear in at least two positions on on all products. All clothing designed by us will show least these FœnX™ logos
• You should be aware that printed colours and dyed colours look different on different fabrics - particularly noticeable with black - and can be shown as different tones on different fabrics, for instance dyed black panels on lycra in nicks compared to printed black panels on cycle jerseys ... and this difference may affect your design; finished goods cannot be refused by you on this basis
• We use fully printable fabric on all our garments, and in the case of Lycra garments and in particular in the case of nicks, where fully printed designs are used, you will see a slight lightening of the colour when the fabric is stretched; finished goods cannot be refused by you on this basis
• You will be advised production time at time of order

NOTE - delays occasionally occur due to reasons outside of our control - FœnX™ accepts no penalty or liability for late deliveries on orders

Custom Gear Step 5

When your goods are ready we will arrange delivery to you using the most economical, trackable shipping method available
All orders are accepted on a first-come-first-serve-basis. Please place your order early. We are busy all year and your delivery date can be affected by when we receive your order and how busy we are at that time. Delivery is subject to the current production schedule and unless a specific date has been agreed upon in writing, delivery may be delayed.
Before we can make delivery of your completed jerseys, where applicable we must receive the cleared balance [including shipping costs], paid in full
Customers that refuse or cancel orders after FœnX™ has received the deposit and the goods have been produced will forfeit the full payment. If artwork has been drawn up but your order has not been manufactured then 50% of the payment constitutes fees for services to that point
NOTE: The goods delivered are based on your chosen signed-off sketch design; based on the sketch, this is what you expect to see when the goods arrive, and this is what we expect to deliver; where you believe the goods do not match the sketch, or if you believe there is a quality issue we have overlooked on any goods, we would like to know within 3 days of delivery, at which time we will take all reasonable steps to remedy the situation
Where there is a manufacturing fault, we will make repairs or replace the garment or provide a refund of the purchase price. FœnX™ will be solely entitled to make a decision as to which of those options will be taken but:
a Repairs, replacements or refunds will be available only within a period of 3 months from the date of delivery on the goods
b You must supply proof of delivery of the goods, which must correspond with our records
